5. Products — Originals and Prints

We offer two primary categories of artwork for sale:

 

5.1 Original Artworks

Original works are one-of-a-kind pieces, sold as unique physical items. Once sold, an original artwork will be removed from the website’s shop and marked as sold, but may continue to appear in our online or physical gallery, portfolio, catalogue, or on third-party platforms and social media for promotional and archival purposes. We retain the right to continue displaying images of any sold original artwork and to produce prints or reproductions of it at any time. All sales of original artworks are final, subject to the warranty provisions in Section 8.

 

5.2 Fine Art Prints

Prints are reproductions of original artworks, produced to a high standard on quality materials. Limited edition prints will be clearly labelled with their edition size and number. Open edition prints may be produced in any quantity at our discretion unless otherwise stated.

 

All artworks are described as accurately as possible. However, colours may appear slightly different on screen compared to the physical item, due to variations in monitor settings, printing processes, and materials. This does not constitute a defect.

6. Changes to Our Offering

We reserve the right, at any time and without prior notice, to:

• Add, remove, or alter the artworks, prints, and other products available on this website.

• Discontinue the sale of any product, series, or edition.

• Change pricing, availability, or product descriptions.

• Introduce new product types, services, or features.

• Withdraw or modify any promotion, discount, or special offer.

 

Changes to the website offering will not affect orders that have already been confirmed and paid for. We will honour all existing confirmed orders in accordance with the terms applicable at the time of purchase.

7. Payment Methods and Pricing

All prices displayed on this website are in GBP and are inclusive of VAT where applicable, unless otherwise stated. Shipping costs are calculated separately at checkout.

Your order is not confirmed until payment has been received in full and you have been sent an order confirmation email. We reserve the right to cancel any order in the event of a pricing error or if payment cannot be verified.

8. Warranties

8.1 What We Promise

We warrant that:

• All artworks and prints sold on this website are genuine and are as described at the time of sale.

• Original artworks are authentic works created by the artist and are free from any third-party ownership claims (to the best of our knowledge).

• Prints are produced using quality materials and processes, and are of satisfactory quality at the time of dispatch.

• All items will be carefully packaged to minimise the risk of damage during transit.

 

8.2 Limitations

We do not warrant or represent that:

• Artworks will exactly match digital representations due to inherent differences in screen calibration and print reproduction.

• Limited edition print values will increase over time — any potential investment value is speculative.

• The website will always be available, free from errors, or uninterrupted.

 

8.3 Your Statutory Rights

Nothing in these Terms and Conditions affects your statutory rights as a consumer under applicable UK or EU consumer protection legislation, including your rights under the Consumer Rights Act 2015 (UK) or equivalent regulations in your country of purchase. If an item arrives damaged, is materially different from its description, or is faulty, you are entitled to a remedy (repair, replacement, or refund) in accordance with those rights.

9. Intellectual Property and Copyright

All artwork, images, photography, text, graphics, designs, and other content displayed on this website are the intellectual property of OrayaArt or are used with permission, and are protected by copyright law and other applicable intellectual property rights.

 

9.1 What You May Not Do

Unless you have received our express written permission, you may not:

• Use any artwork or image from this website for commercial purposes, including but not limited to merchandise, advertising, or resale.

9.2 Purchase of Physical Artwork

The purchase of an original artwork or print transfers ownership of the physical item only. It does not transfer any intellectual property rights, including copyright, in the artwork. The copyright in all artworks remains with OrayaArt unless explicitly agreed otherwise in writing.

 

9.3 Personal Use of Images

You may share images of purchased artworks on personal social media for non-commercial purposes, provided that you credit Oraya Rogers from OrayaArt as the artist. Commercial use of any purchased artwork image (including use in publications, advertising, or products) requires a separate licence agreement.

 

9.4 Reporting Infringement

If you believe that any content on this website infringes your intellectual property rights, please contact us at art.oraya.rogers@gmail.com with full details of your claim.

10. Shipping and Delivery

We aim to dispatch all orders within 30 business days of payment confirmation. Delivery timescales vary depending on destination and shipping method selected at checkout. We are not liable for delays caused by third-party couriers, customs processes, or circumstances beyond our control.

Risk in the goods passes to you upon delivery. If your item arrives damaged, please contact us within [48 hours / 7 days] of receipt with photographic evidence so we can arrange an appropriate remedy.

11. Returns and Cancellations

Under the UK Consumer Contracts Regulations 2013 (and equivalent legislation), you may have the right to cancel your order within 14 days of delivery and return the item for a refund, provided the item is returned in its original, undamaged condition.

Please note: bespoke or personalised artworks created to your specification are exempt from this right of return unless they arrive damaged or faulty.

To initiate a return, please contact us at art.oraya.rogers@gmail.com before sending any item back. Return postage costs are the responsibility of the buyer unless the item is faulty or was incorrectly sent.

12. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of this website or the purchase of any product, including loss of profits, loss of data, or loss of enjoyment.

Our total liability to you for any claim arising from a purchase shall not exceed the total value of the order in question.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
